* What is the purpose of this website?
The information contained on these pages is not provided as a tool for harassment. Do not use it as such. It is provided so that it may be used in conjunction with peaceful and lawful forms of civic involvement (e.g. service of process, researching criminal history, organizing lawful pickets, etc.). This website is for improving transparency and accountability in our public institutions, and to provide citizens with a forum for commentary; political or otherwise.
* Why is there a need for this website?
The anonymity that officers have enjoyed has led to a police force without discipline, and few consequences for unlawful activity. Law enforcement officials should not be treated differently than the citizens they are sworn to protect.
* After all these years of corruption, what was the last straw?
The years of Reynoldsburg police officers harassing teenagers – which ultimately led to the “suicide” of James “Cephus” Potts. Click here. It’s sad that the late-night shift of officers felt the need to keep dragging Cephus into the station and calling him a “scumbag.” (Is it a coincidence that the mayor referred to the creator/editor of this site by this same term? Did Mayor McCloud attend the same “leadership” seminar as the officers?)
* Which court case(s)/decision(s) allows you to post the names and personal information of police officers and political officials?
City of Kirkland v. Sheehan
Brayshaw v. City of Tallahassee
Basically, both U.S. District Courts upheld that, “Merely publishing an officer’s address and phone number, even with intent to intimidate, is not a ‘true threat’ as defined in constitutional law jurisprudence” and, “addresses and telephone numbers of police officers are not ‘fighting words’ or incitements to imminent lawless action.” Also, this information is “truthful, lawfully-obtained, publicly-available personal identifying information” and, “disclosing and publishing information obtained elsewhere is precisely the kind of speech that the First Amendment protects.”
* What legal case defines “inciting or producing imminent lawless action” and allows you to post your political commentary?
Brandenburg v. Ohio – 395 U.S. 444
* How were you able to get city budget numbers?
Someone was nice enough to upload the city’s budget to the “Reynoldsburg Taxpayers Against Open Enrollment” Facebook page. The city must also provide these documents to any citizen who asks for them.
* Why are you allowed to use images taken from Facebook?
Facebook: Statement of Rights and Responsibilities (Sharing Your Content and Information):
“When you publish content or information using the Public setting, it means that you are allowing everyone, including people off of Facebook, to access and use that information, and to associate it with you (i.e., your name and profile picture).”
